Handbook on Trans-Tasman Civil Proceedings

This project involves the creation of an online, open source handbook that will be a guide for lawyers and litigants involved in trans-Tasman civil proceedings.

About the project

The Trans-Tasman Proceedings Act 2010 and its counterpart legislation in Australia created a new regime for civil proceedings that involve New Zealand and Australia. The regime has now operated successfully for over a decade, but there is no comprehensive guidance available to practitioners and litigants on the operation of the regime.

Through this project, the Australasian Association of Private International Law plans to create an open-source handbook that brings together the legislation of both countries and other primary sources, explains the background and operation of the regime, and navigates the case law that has been developed since 2010. The handbook will be hosted online and regularly updated, and will be available as a resource for both practitioners and litigants navigating the complexities of cross-border disputes involving the two countries.

About the Australasian Association of Private International Law

The Australasian Association of Private International Law was founded in 2024 by a group of Australian and New Zealand academics and lawyers to promote the understanding and development of private international law in Australasia and the Pacific. The project will be led by a general editor from New Zealand (Jack Wass) and from Australia (Professor Reid Mortensen).
